中英文-信阳市招商引资项目引荐人奖励办法

    为鼓励全市党政机关、企事业单位工作人员及社会各界人士积极参与招商引资，形成“全民招商”浓厚氛围，持续开展“招大引强”，大力实施“工业强市,工业兴市”战略，引进更多投资规模大、科技含量高、财政贡献大的工业项目和高成长性产业项目落户信阳，进一步提高全市招商引资水平，扩大有效投资，结合工作实际，特制定本办法。

一、项目引荐人认定程序

1.项目引荐人是指通过各种渠道为我市引进外来投资项目的国内外个人或团体。引荐人应在项目被引过程中起重要作用，在项目前期洽谈、对接和后期签约、落地建设过程中全程跟踪参与。项目引荐人不包括引进项目的投资者和合作者。引荐人需由项目单位和受益单位共同确认无异议方予以认可。

2.引荐人申报奖励时，如引荐人超过 1 人或以团体形式引荐的，应自行协商确定 1名人员或以团体的 1名负责人为填表登记人，并承担相应的责任。

3.在项目开工建设三个月内，引荐人持投资方和受益方为其出具的引荐证明，到各县区政府、管理区（开发区）管委会商务局（招商）部门领取并填写《信阳市招商引资项目引荐人备案表》。商务（招商）部门对项目引荐人提供的信息和提交的相关资料进行审核把关。

二、项目奖励认定程序

1.引荐人引荐项目应为我市新引进的鼓励类项目，对各类金融贷款、原有外来投资企业扩建项目、房地产开发项目、中央、省属驻信单位的投资项目、向上争取资金的项目、ppp项目以及商业地产开发项目非自持经营部分不予认定奖励。

2.引荐人引进的项目，以形成地方税收为奖励基数，其中，引进的工业项目当年税收在50万元以上，社会事业、文化旅游等其它项目竣工投产前税收在100万元以上。

3.每年 12 月初，引荐人到各县区政府、管理区（开发区）管委会商务（招商）部门领取并填写《信阳市招商引资项目引荐人确认表》，提供引进外来企业合同、工商营业执照、受奖者身份证明（提供复印件并核对原件）等材料。

4.年终由各县区政府、管理区（开发区）管委会商务（招商）部门牵头，会同财政、审计、税务等部门组成考核小组，对引荐人引进的项目投入资金、建设、纳税等情况进行考核后，提出初步奖励意见，报辖区政府研究决定。 

三、项目引荐人奖励标准

1.奖励资金根据项目和引荐人情况分类界定标准，对非公职人员引荐的工业项目，按项目投产后当年形成税收地方留成部分的10%进行奖励，并连续奖励三年（从纳税第一年开始）；引荐的文化旅游和社会事业等其它项目，按形成税收地方留成部分（包括工程建设过程中形成的税收）的10%进行奖励（项目竣工投产后一次性奖励）。对公职人员引荐的各种鼓励类招商引资项目，年终予以通报表彰，并作为个人评先评优，优先提拔的重要依据。

2.奖金按谁受益谁兑付的原则，由受益地方财政进行兑付。

3.项目引荐人所得奖金，应依法缴纳个人所得税，税款由兑付单位代扣代缴。

四、附则

1.对引进的新型业态项目及税收低、就业贡献大的项目，采取一事一议。

2.本办法自2017年10月1日起执行。以前所出台文件与本办法不一致的，按本办法执行。

1. Identification procedure of project introducer

 

1. Project introducers refer to individuals or groups at home and abroad who introduce foreign investment projects to our city through various channels. The introducer shall play an important role in the introduction process of the project, and track and participate in the whole process of early negotiation, docking, later signing and landing construction of the project. The project introducer does not include the investors and partners of the introduced project. The introducer shall be jointly confirmed by the project unit and the beneficiary unit, and shall be recognized only if there is no objection.

 

2. When applying for awards, if there is more than one introducer or in the form of a group, the introducer shall negotiate and determine one person or one person in charge of the group as the person who fills in the form and assumes corresponding responsibilities.

 

3. Within three months after the commencement of the project, the introducer shall take the introduction certificate issued by the investor and the beneficiary to the county and district government, the Management Committee of the management zone (Development Zone) and the Commerce Bureau (investment promotion) department, and fill in the filing form of introducer of Xinyang investment promotion project. The business (investment) department shall review and check the information provided and relevant materials submitted by the project introducer.

 

Ⅱ.Project award recognition procedure

 

1. The projects recommended by the introducer shall be the newly introduced encouraged projects in our city. All kinds of financial loans, expansion projects of original foreign-invested enterprises, real estate development projects, investment projects of central and provincial credit units, projects striving for funds, PPP projects and non self owned business parts of commercial real estate development projects shall not be recognized and rewarded.

 

2. For the projects introduced by the introducer, the incentive base is the formation of local tax. Among them, the tax of the introduced industrial projects in the current year is more than 500000 yuan, and the tax of social undertakings, cultural tourism and other projects is more than 1 million yuan before they are completed and put into operation.

 

3. Early December of each year , the introducer shall go to the commercial (investment) Department of the county and district government and the Management Committee of the administrative zone (Development Zone) to receive and fill in the confirmation form of the introducer of investment promotion projects in Xinyang City, and provide materials such as the contract for introducing foreign enterprises, industrial and commercial business license, and the identity certificate of the winner (provide copies and check the original).

 

4. At the end of the year, the county and district governments and the business (investment) Department of the Management Committee of the management zone (Development Zone) shall take the lead to form an assessment team together with the financial, audit, tax and other departments to assess the investment, construction and tax payment of the projects introduced by the introducer, put forward preliminary incentive opinions and report them to the government of the jurisdiction for research and decision.

 

Ⅲ.Reward criteria for project introducers

 

1. According to the classification and definition criteria of the project and the introducer, the incentive fund will reward the industrial projects introduced by non-public officials according to 10% of the local tax retention in the year after the project is put into operation, and reward for three consecutive years (starting from the first year of tax payment); Other projects，such as cultural tourism and social undertakings，introduced will be rewarded at 10% of the local retained part of the tax (including the tax formed in the process of project construction) (one-time reward after the project is completed and put into operation).Various encouraged investment promotion projects introduced by public officials shall be notified and commended at the end of the year, and shall be used as an important basis for individual evaluation and priority promotion.

 

2. The bonus shall be cashed by the beneficiary local finance according to the principle of who benefits and who pays.

 

3. The individual income tax shall be paid according to law for the bonus obtained by the project introducer, and the tax shall be withheld and paid by the cashing unit.

 

Ⅳ. Supplementary Provisions

 

1. For the introduced new type of business projects and projects with low tax and high employment contribution, it shall be discussed on a case by case basis.

2. The measures shall be implemented as of October 1, 2017. If the previously issued documents are inconsistent with these measures, these Measures shall prevail.
