    现将《关于进一步鼓励利用外资高质量发展若干措施》印发给你们，请结合实际，认真抓好落实。

信阳市进一步鼓励利用外资高质量发展若干措施

    为落实《关于积极有效利用外资推动经济高质量发展若干措施的通知》（国发〔2018〕19号）、《关于积极有效利用外资推动经济高质量发展的通知（豫政〔2018〕19号）等文件精神，进一步做好全市利用外资工作，促进经济高质量发展，特制订本措施。

一、落实《外商投资准入特别管理措施（负面清单）》。负面清单之外的领域，按照内外资一致原则实施管理，各区、各部门不得专门针对外商投资准入进行限制。按照内外资企业统一标准、统一时间原则，审核登记负面清单之外的外商投资项目的注册申请、业务牌照和资质申请等，确保内外资企业公平竞争。

二、扩大服务业利用外资。支持外资金融机构来我市发展，扩大业务范围、拓宽合作领域。支持外资银行在信阳同时设立子行。支持外商在信阳合资设立证券公司、证券投资基金管理公司、期货公司、寿险公司。鼓励外商投资科技研发、信息技术、现代物流、创意设计、节能环保、服务外包、商务咨询等生产性服务项目，以及医疗、养老、教育等民生服务项目。

三、鼓励外商投资先进制造业、战略新兴产业。支持外商投资参与“六新”（新基建、新技术、新材料、新装备、新产品、新业态）产业建设，重点投向装备制造、绿色食品、电子制造、先进金属材料、新型建材、现代轻纺等先进制造业，新型显示和智能终端、生物医药、节能环保、新能源及网联汽车、新一代人工智能、网络安全、尼龙新材料、智能装备、智能传感器、5G等战略新兴产业。争取省招商引资奖励资金支持，对重大招商引资项目实际到位资金1000万美元，奖励50万元人民币，每增加1000万美元，奖励资金增加50万元人民币。

四、支持外商投资投向高新技术产业、科技创新平台。鼓励高等院校、科研院所、相关企业与外商联合在我市投资建设各类研发机构，并申报各级各类科技发展计划项目。重点支持外资在我市发展产业创新中心、技术创新中心、工程研究中心、新型研发机构等研发创新机构。对经认定为省级重大新型研发机构的外资研发机构，按照我省重大新型研发机构遴选和资助相关规定，给予最高500万元的奖补支持。鼓励外资投向高技术、高附加值服务业，经认定为技术先进型服务企业的外商投资企业，减按15%的税率征收企业所得税。鼓励外商与各类政府引导基金联合设立创业投资基金，重点支持境外科研成果在我市孵化转化。

五、鼓励外商投资参与基础设施建设。支持外商以特许经营等方式参与我市能源、交通、水利、环保、市政公用工程等基础设施建设。积极试点外商投资参与有关区域的“冷热电”三联供、污水及垃圾处理、地下综合管廊、公路、港口等项目建设。

六、保护外商投资企业知识产权等合法权益。深入推进打击侵犯外商投资企业知识产权和制售假冒伪劣商品工作。支持外商投资企业在取得的发明、发现和其他科技成果，参与国家和省市各类奖项评审。允许符合条件的境外投资者自由转移其在我市的合法投资收益。市外商投诉中心要及时受理、督办、解决外商投资企业对国家机关及其公职人员违反法律法规、招商引资工作纪律、损害经济发展软环境等行为的投诉。

七、鼓励中介机构引荐外商投资项目。对非公职人员引荐的工业项目，按项目投产后当年形成税收地方留成部分的10%进行奖励，并连续奖励三年；引荐的文化旅游和社会事业等其他项目，按形成税收地方留成部分的10%进行奖励。对成功引进重大招商引资项目的中介机构或企业，项目到位资本金每5000万元给予10万元的奖励，单个项目奖励最高不超过100万元。

Some measures for Xinyang City to further encourage the use of foreign capital for high-quality development

In order to implement the spirit of the notice on several measures for actively and effectively utilizing foreign capital to promote high-quality economic development ( [2018] No.2 Document of State Council ), the notice on actively and effectively utilizing foreign capital to promote high-quality economic development ( [2018] No.19 Document of Henan government) and other documents, further do a good job in the utilization of foreign capital throughout the city and promote high-quality economic development, these measures are hereby formulated.

1. Implement the Special Administrative Measures for foreign investment access (negative list). Areas outside the negative list shall be managed in accordance with the principle of consistency between domestic and foreign investment, and all districts and departments shall not restrict the access of foreign investment. In accordance with the principle of unified standards and time for domestic and foreign-funded enterprises, review the registration application, business license and qualification application of foreign-invested projects outside the negative list of registration, so as to ensure fair competition between domestic and foreign-funded enterprises.

2. Expand the use of foreign capital in the service industry. Support foreign-funded financial institutions to develop in our city, expand business scope and expand cooperation fields. Support foreign banks to set up subsidiaries in Xinyang at the same time. Support foreign investors to establish joint ventures  securities companies, securities investment fund management companies, futures companies and life insurance companies in Xinyang. Foreign investors are encouraged to invest in productive services such as scientific and technological research and development, information technology, modern logistics, creative design, energy conservation and environmental protection, service outsourcing and business consulting, as well as livelihood services such as medical treatment, elderly care and education.

3. Encourage foreign investment in advanced manufacturing and strategic emerging industries.Support foreign investment in the construction of ＂new infrastructure, new technology, new materials, new equipment, new products and new business forms＂, focusing on advanced manufacturing industries such as equipment manufacturing, green food, electronic manufacturing, advanced metal materials, new building materials and modern light textile, new display and intelligent terminals, biomedicine, energy conservation and environmental protection, new energy and Internet connected vehicles, new generation of artificial intelligence, network security, nylon new materials, intelligent equipment, intelligent sensors, 5G and other strategic emerging industries.Strive for the support of provincial investment promotion incentive funds. For major investment promotion projects, the actually paid in funds of US $10 million will be rewarded with RMB 500,000. For each increase of US $10 million, the incentive funds will increase by RMB 500,000.

4. Support foreign investment in high-tech industries and scientific and technological innovation platforms. Encourage colleges and universities, scientific research institutes, relevant enterprises and foreign businessmen to jointly invest in the construction of various R & D institutions in our city, and apply for various scientific and technological development plans and projects at all levels. Focus on supporting foreign capital to develop R & D and innovation institutions such as industrial innovation center, technological innovation center, engineering research center and new R & D institutions in our city. Foreign funded R & D institutions recognized as provincial major new R & D institutions will be given a subsidy of up to 5 million yuan in accordance with the relevant provisions on the selection and funding of major new R & D institutions in our province.Encourage foreign investment in high-tech and high value-added service industries. Foreign invested enterprises recognized as technologically advanced service enterprises shall be subject to enterprise income tax at a reduced rate of 15%. Encourage foreign investors and various government guidance funds to jointly set up venture capital funds, focusing on supporting the incubation and transformation of overseas scientific research achievements in our city.

5. Encourage foreign investment to participate in infrastructure construction. Support foreign investors to participate in the construction of energy, transportation, water conservancy, environmental protection, municipal public works and other infrastructure in our city by means of franchising. Actively pilot foreign investment to participate in the construction of "cooling, heating and power supply" , sewage and waste treatment, underground comprehensive pipe gallery, highway, port and other projects in relevant regions.

6. Protect the intellectual property rights and other legitimate rights and interests of foreign-invested enterprises. We will further promote the fight against infringement of intellectual property rights of foreign-invested enterprises and the production and sale of fake and shoddy goods. Support foreign-invested enterprises in their inventions, discoveries and other scientific and technological achievements, and participate in the evaluation of various national, provincial and municipal awards.Qualified foreign investors are allowed to freely transfer their legitimate investment income in our city. The municipal foreign investment Complaint Center shall promptly accept, supervise and solve the complaints of foreign-invested enterprises against the violation of laws and regulations, the work discipline of attracting investment and the damage to the soft environment of economic development by state organs and their public officials.

7. Intermediary agencies are encouraged to introduce foreign investment projects.Industrial projects introduced by non-public officials will be rewarded at 10% of the local tax retained in the year after the project is put into operation, and will be rewarded for three consecutive years; other projects such as cultural tourism and social undertakings introduced will be rewarded at 10% of the local retained part of the tax. For intermediaries or enterprises that successfully introduce major investment promotion projects, 100000 yuan will be awarded for every 50 million yuan of capital in place, and the maximum reward for a single project shall not exceed 1 million yuan.
